to Terms
By using the Websites, you agree to this Agreement and the
ArrestRecords.org
Privacy Policy, which is incorporated into this Agreement by reference.
Each time you use a Website, you reaffirm your acceptance of the
then-current Terms of Use. If you do not wish to be bound by this
Agreement, you may discontinue using the Websites. You cannot
purchase any services on the Websites until you have accepted
the terms of this Agreement.
ArrestRecords.org may change the terms of this Agreement
at any time, in its sole discretion, and without notice to you.
The modified Terms of Use will be effective immediately upon posting
and you agree to the new posted Terms of Use by continuing your
use of the Websites. You are responsible for staying informed
of any changes. If you do not agree with the modified Terms of
Use, your only remedy is to discontinue using the Websites.
Terms of Purchase
After you make a purchase on a Website, you will gain access to
our Member’s area, a one stop source for all your information
needs. The Member’s area combines the power of over 30 different
searches, tools, and resources to help you in your investigation
process. Our Member’s area is conveniently divided into
two types of searches, Direct and Unlimited (as more fully described
below). Your “Report and Membership Access” fee will
grant you access to our Member’s area and also it will be
your Direct search balance. You can use these funds to execute
various Direct searches. Please note that your credit card or
your Paypal account is not charged each time you conduct Direct
searches. The cost per each Direct search will be deducted from
your Direct search balance. Should you run out of funds, you may
purchase additional searches in our Member’s area. After the
expenditure of your funds, your subsequent use of the
ArrestRecords.org’s products and services will be subject
to ArrestRecords.org’s
then-current rates. You can also purchase an “Unlimited
Search Pass” for an additional fee which will grant you
access to our “Unlimited” section of the Member’s
area. Searches included with the Unlimited Search Pass will vary
depending on the Website on which you originally signed up.
Direct searches may include: Bankruptcy Records search, Birth
Records search, Business Records search, Comprehensive Background
search, Court Records Search, Criminal Records search, Death Index
search, Email search, Federal Records search, Legal/Civil Judgments
search, Marriage/Divorce search, People Search, Person Report,
Property Records, Relatives search, Reverse Cell Phone search,
Reverse Landline Phone search, Reverse IP search, Sex Offender
Search, SSN Validation search, SSN Records search, Vessel/Watercraft
Records search, and Warrant search.
Unlimited reports may include: Address history, age, date of birth,
marital status, phone number(s), possible relatives and associates,
property records, business searches, neighborhood checks, reverse
IP search, people searches by name, phone and address.
You agree and acknowledge that except as otherwise indicated,
you will be charged for any Direct search, regardless of whether
your search yields any reports or records, and regardless of whether
any such report or record contains incorrect information or no
information at all.
Data on the Websites
The Websites allow you to conduct searches of various public
records, as described above. Any data presented as a result of
these searches (the “Data”) is derived from records that are not
in the control of ArrestRecords.org and may not always
be accurate or complete. Please see the Warranties section below
for more information. If you have questions about any Data, or
wish to dispute the accuracy of any Data, you should contact the
official record keeper.
Criminal Records Coverage Areas
You understand that some states do not permit access to certain
types of criminal records, or restrict the types of information
that may be retrieved by a criminal search, and that as a result,
not all searches will return reports or records.
Your Account
Only individuals who are United States residents who are
eighteen (18) years of age or older may create an account and
conduct searches on the Websites. Accounts are for individual
use and you are strictly prohibited from allowing third parties
to use your account. You are entirely responsible for
maintaining the confidentiality of your account and you agree to
indemnify and hold harmless ArrestRecords.org for losses
incurred by ArrestRecords.org or another party due to any use of
your account by a third party. You agree to notify
ArrestRecords.org immediately if you become
aware or suspect that any third party is using your account.
Use of Data
By conducting any searches on the Websites, you represent and
warrant that you will only use the Websites and Data for a
lawful purpose. Examples of lawful purposes include, but are not
limited to: (a) fraud prevention; (b) asset verification; (c)
location of criminals, witnesses, beneficiaries, or heirs; (d)
research for debt collection activities; (e) child support
enforcement; and (f) compliance with federal, state, or local
laws or regulations. You may not use the Websites or Data for
any unlawful purpose. Examples of unlawful purposes include, but
are not limited to: (a) stalking or harassing any individual;
(b) requesting information under false pretenses; and (c) using
Data for any other purpose prohibited by law (“Unlawful
Purposes”). Furthermore, you agree not to access, reproduce,
duplicate, sell, resell, transfer, or exploit the Data for any
commercial purposes. NOTE: ArrestRecords.org
is not a consumer reporting agency as defined under the Fair Credit
Reporting Act ("FCRA"), and the information in our databases
has not been collected in whole or in part for the purpose of
furnishing consumer reports, as defined in the FCRA. You may not
use the Websites or Data to: (a) establish an individual's legibility
for personal credit or insurance; (b) assess risks associated
with existing consumer credit obligations; or (c) evaluate an
individual for employment, promotion, reassignment or retention
(including employment of household workers such a nannies, housekeepers,
or contractors) or in conjunction with assessing the merits of
entering into any other personal business transaction with another
individual (“Unauthorized Purposes”).
Copyrights and Trademarks
The Websites, and any information and materials contained
therein, including but not limited to graphics and editorial
content, are owned by ArrestRecords.org and/or its licensors,
and are protected by copyright, trademark, patent, trade secret,
and/or other laws. ArrestRecords.org and/or its licensors own
and retain all rights, including the worldwide copyright, in the
content solely and exclusively, for the duration of the rights
in each country, in all languages, and throughout the universe.
You agree that you shall not use the content in any way whatsoever
except as in compliance with the terms of this Agreement. You
agree not to modify, rent, lease, loan, sell, distribute, redistribute,
or create derivatives works based on the content, and you shall
not exploit the content in any unauthorized way whatsoever, including
but not limited to by trespass or burdening network capacity.
You agree not to alter or delete any proprietary notices from
CIS Content downloaded or printed from the Websites.
All brand and product names are trademarks or registered trademarks
of their respective companies. You are prohibited from using any
of the marks or logos appearing throughout the content without
express permission from the trademark owner, except as permitted
by applicable law.
Warranties
ArrestRecords.org provides access to Data compiled and
maintained by third parties. ArrestRecords.org does not create,
verify, or guarantee the accuracy of such Data.
ArrestRecords.org
is not necessarily affiliated with, endorsed by, or compensated
by these third parties.
THE DATA AND THE WEBSITES ARE PROVIDED “AS IS” WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE
FULLEST EXTENT POSSIBLE UNDER APPLICABLE LAWS, ArrestRecords.org
DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT
NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR OTHER VIOLATION
OF RIGHTS. ArrestRecords.org DOES NOT WARRANT OR MAKE
ANY REPRESENTATIONS REGARDING THE USE, VALIDITY, ACCURACY, OR
RELIABILITY OF, OR THE RESULTS OF THE USE OF, OR OTHERWISE RESPECTING,
THE DATA OR THE WEBSITES. YOUR USE OF THE WEBSITES AND DATA IS
SOLELY AT YOUR OWN RISK.
Limitation of Liability
ArrestRecords.org’s entire liability and your exclusive
remedy with respect to any dispute with ArrestRecords.org is to
discontinue your use of the Websites. ArrestRecords.org and its
vendors shall not be liable for any indirect, special,
incidental, consequential, or exemplary damage arising from your
use of the Websites or for any other claim related in any way to
your use of the Websites. These exclusions for indirect,
special, incidental, consequential, or exemplary damages
include, without limitation, damages for lost profits, lost
data, loss of goodwill, work stoppage, computer failure or
malfunction, or any other commercial damages or losses, even if
ArrestRecords.org had been advised of the possibility thereof
and regardless of the legal or equitable theory upon which the
claim is based. Because some states or jurisdictions do not
allow the exclusion or the limitation of liability for
consequential or incidental damages, in such states or
jurisdictions, ArrestRecords.org’s and
its vendors’ liability shall be limited to the extent permitted
by law.
Indemnification
By using the Websites, you agree to indemnify and hold
ArrestRecords.org,
its directors, officers, employees, affiliates, agents, contractors,
licensors, and subsidiaries harmless from any loss, liability,
claim, or demand, including reasonable attorneys’ fees,
made by any third party due to or arising out of (i) your use
of the Websites or Data in violation of this Agreement, (ii) your
use of the Websites or Data for Unlawful or Unauthorized Purposes,
and/or (iii) your breach of this Agreement or your violation of
any law or the rights of a third party.
Termination
ArrestRecords.org has the right to terminate or restrict your
account and/or access to the Websites for any reason, or no
reason whatsoever, including, without limitation, if
ArrestRecords.org, in its sole discretion, considers your use to
be unacceptable, or in the event of any breach by you of the
Terms of Use. ArrestRecords.org may, but shall be under no
obligation to, provide you a warning prior to termination or
restriction of your use of the Websites. ArrestRecords.org will
not be liable to you or any third party for its termination or
restriction of your account and/or access. ArrestRecords.org also reserves the right to
terminate any Website or any part of any Website at any time,
without notice or liability to you.
Hyperlinks
The Websites may contain hyperlinks to third-party websites as a
convenience to you. ArrestRecords.org does not control or
endorse these third-party sites or any goods or services sold on
those sites. Some of these sites may contain materials that are
objectionable, unlawful, or inaccurate. You acknowledge and
agree that ArrestRecords.org is not responsible or liable
for any content or other materials on these third party sites.
Use of Ideas Submitted
You hereby acknowledge and agree that ArrestRecords.org is free
to use any comments, suggestions, information, concepts,
reviews, techniques, or other information contained in any
communication you may send to ArrestRecords.org or may have with
a ArrestRecords.org representative (the “Ideas”), and that
ArrestRecords.org shall have no obligation to compensate you in
any way for the Ideas, even if the Ideas are used by
ArrestRecords.org for commercial purposes, including, but not
limited to, use by ArrestRecords.org
for improving the Websites or for developing and marketing any
products or services.
Electronic Notices
By using the Websites, you agree to receive electronic
communications from ArrestRecords.org. You agree that any notice or
other communication that we send you electronically will satisfy
any legal communication requirements, including that such communications
be in writing.
Arbitration
Any dispute concerning the Data, the Websites, or this Agreement
shall be settled by binding arbitration in Boston, Massachusetts,
in accordance with the Commercial Arbitration Rules of the American
Arbitration Association. Judgment upon the award made by the Arbitrator(s)
may be entered in any court having jurisdiction thereof. You acknowledge
that agreeing to such binding arbitration constitutes a waiver
of your right to a jury trial and that this agreement to arbitrate
is voluntary and not legally required. If any arbitration or legal
action or similar proceeding is instituted by either party concerning
the payment of our fees or costs advanced hereunder, the prevailing
party shall be entitled to collect its reasonable attorneys’
fees in addition to any other relief the party may obtain.
If any provision of this Agreement is found to be invalid by any
court having any competent authority, the invalidity of such provision
shall not affect the validity of the remaining provisions of this
Agreement, which shall remain in full force and effect. No waiver
of any provision in this Agreement shall be deemed a further or
continuing waiver of such provision or any other provision.
General
Data, materials, features, products and services may be added
to or withdrawn from the Websites or otherwise changed without
notice.
The Websites are not affiliated with the United States Government
or any Federal or State government agency.
Opt Out Policy
An individual may request opt-out if one of these conditions exists:
You are a state, local or federal law enforcement officer or public
official and your position exposes you to a threat of death or
serious bodily harm; or you are a victim of identity theft; or
you are at risk of physical harm; or you have evidence the record
is incorrect or expunged.
To opt-out, submit the following information: A written explanation
of the reason for removal request; and all request must include:

obtains data from multiple sources and opting out of publicly
available data may not affect the availability of records to Government
entities, Law Enforcement, Business community, or for other legally
permissible purposes. In addition, we have no control over records
provided by 3rd party vendors.
Definitions
The following Definitions shall apply to the access to and use
of the ArrestRecords.org services and products.
“User” includes the individual subscriber, its owners, partners,
employees, agents, contractors and subcontractors. User agrees
that it is responsible for the use of the ArrestRecords.org
services and products by any temporary employee and independent
contractor or subcontractor to the same extent as if such were
an employee of the User. “User” does not include customers,
clients, or other third-parties with whom User has a business
relationship.
“Intranet Website” means the User’s internal
website accessible only to User’s owners, partners, employees,
onsite temporary employees or independent contractors. No third
parties shall have access to the Intranet Website.
“Link” means a URL (or icon, highlighted or colored text, figure
or image representing a URL) on which a User may “point and
click” or otherwise send a “command” to access any part of a
ArrestRecords.org website.

records from any state or federal court, the right to retrieve
the public data via the downloading commands of the

websites, is limited primarily for one User’s exclusive
use, a single copy of that public data obtained, that is not further
limited or otherwise prohibited herein.
These Terms and Conditions of Purchase and Use ("Terms")
are between ArrestRecords.org and "you", the
person using ArrestRecords.org’s materials, web
site and Member Services department ("Our Services").
By using Our Services you accept the Terms.

2. Terms of Purchase
The day you order our Services marks the beginning of your ability
to access Our Services. You will have the use and access of the
ArrestRecords.org products and services in exchange
for the payment of funds and fees as set forth herein.
Our data is conveniently organized into three sections: Comprehensive
Background Report, Direct Searches, and Unlimited Searches. The
“Unlimited” background searches are included in your
membership and you can access them without any restrictions. All
“Direct” searches and the “Comprehensive Background
Report” search require funds to access.

We have three membership options, “Basic”, “Premium”
and “Ultimate”. These plans differ in two ways: duration
of access to services and amount of funds included. All three
types of subscriptions grant access to our members' area where
all our searches are located, including our “Unlimited"
people searches and investigative resources. However, Basic and
Premium subscribers can access our members' area only until their
memberships expire. Only our Ultimate membership plan offers unrestricted
access to our members' area without any expiration date.
In addition to receiving access to our members' area, subscribers
also receive a set amount of funds which can be used to conduct
paid searches, including all "Direct" searches and the
"Comprehensive Background Report" search. We automatically
credit funds to subscribers' ArrestRecords.org accounts.
Once you are logged in, you may view your account details in the
top left corner of the page.
The amount of funds that each subscriber receives depends on the
membership option that he or she chooses. The minimum “Basic”
subscription comes with enough funds for a complete individual
investigation and records look-up. Should you run out of funds,
you may purchase additional searches in our members' section.
After the expenditure of your funds, your subsequent use of the
ArrestRecords.org's products and services will be subject
to ArrestRecords.org’s then-current rates. We
use only SSL encryption technology to protect the security of
your credit card information and financial data as it is transmitted
to us.
3. Privacy Policy
Registration, membership and certain other information about you
is subject to our Privacy Policy. For more information, see our
full Privacy Policy.
ArrestRecords.org values its customers and respects
their privacy. We collect only public data for your use subject
to the Terms and Conditions set forth herein and also for billing
and payment for our products and services accessed by You in order
to improve your ArrestRecords.org experience and to
communicate with You about our products, services and promotions.
ArrestRecords.org recognizes that it must maintain and
use Your information in a conscientious manner.
We collect information about You (such as your name, e-mail address,
a record of the accessed data, and other information) and save
that information in our secure databases to confirm your order,
process your payments, and to quickly assist you when you have
a question or problem about your order.
ArrestRecords.org acquires public data, records, and
non-public information only from established, reputable sources
in the government and private sectors Reasonable steps are taken
to (a) review the supplier’s data collection practices and
policies; (b) review the supplier’s business practices;
(c) review the financial condition of the data supplier; and (d)
review the types of data the supplier sells (i.e. public record,
publicly available, or non-public information.)

obtains a written assurance from each data provider that the supplier
has the legal right to sell the data to ArrestRecords.org.
ArrestRecords.org websites may contain links to other
sites that are not under our control. These websites may contain
policies regarding privacy and other terms that are different
from those of ArrestRecords.org. In such cases, you
should review those websites’ privacy policies before visiting
them. We have no responsibility for the content of these other
websites and provide them solely for Your convenience.
ArrestRecords.org and its affiliates regularly monitor
its business practices to ensure compliance with its Privacy Policy
set forth herein.
ArrestRecords.org may access or disclose information
about You, your account, and/or the content our communications,
in order to: (a) comply with the law or legal process served on
us; (b) enforce and investigate potential violations of the Conditions
and Terms of Use, including use of our products and services to
participate in, or facilitate, activities that violate the law;
or (c) protect the rights, property or safety of
ArrestRecords.org
and its affiliates, its employees, its customers or the public.
You hereby consent to the access and disclosures outlined herein.
If our data collection practices change in the future, we will

4. Limitations of Usage
Membership is limited to individuals 18 years and older. Consistent
with the Children’s Online Privacy Protection Act of 1998,
we will never knowingly personally identify or provide personally
identifiable information to or from anyone under the age of 13
without prior verifiable consent. If we become aware that a User
is under the age of 13 and has accessed a ArrestRecords.org
website without prior parental consent, we will remove his or
her personally identifiable information from our websites.
Your membership is solely for personal use. You agree that you
will not provide access to Our Services to non-members through
your account, and that you are fully responsible for all activities
under your password or account. ArrestRecords.org.com
will not be liable for any loss or damage arising from such activities,
and reserves the right to terminate your access to Our Services,
with or without notice.
5. Access and Interface
You agree that you will use reasonable efforts to restrict access

on Your or any other person or entity’s home webpage without
prior express permission and authorization from

To the extent that you suspect or become aware of any unauthorized
user or employee accessing ArrestRecords.org websites,
or we become aware that such access appears to be occurring through
audits conducted by us, then You and ArrestRecords.org
will jointly agree on corrective action to be taken that may include
the following: (a) payment of additional fees, and (b) Your implementation
of necessary technology or your intranet website to restrict access
to authorized Users.
You agree not to share your personal identification information
with any third party.
ArrestRecords.org will provide You with public data
that is retrieved by means of a “Search” conducted
by “clicking on” a “button” on the
ArrestRecords.org
website that corresponds to the desired public data.
If You copy, co-mingle, or interlineate any public data obtained
from a ArrestRecords.org website, You agree that any
such use will bear and contain ArrestRecords.org branding
and include a copy of all applicable copyright notices.
You are strictly prohibited from displaying any data obtained
or retrieved from any ArrestRecords.org website on any
public-facing website or on any password-protected, members-only
portion of Your website that is accessible to third parties that
have a business relationship with you, including your clients
and customers.
You shall not use or permit the use of any ArrestRecords.org
website product or service in any way that compromises the integrity
thereof or that infringes any copyrights or propriety interests
on any third party. Furthermore, you shall not use the

products and services to conduct ad hoc searches of

products and services. A breach of this Section shall be grounds
to immediate termination of your use of the ArrestRecords.org

you agree that you will not use any robot, spider, other automatic
device, or manual process to monitor or copy the web pages or

You further agree that you will not use any device, software or

Our Services may NOT be used for the following uses:

2. For locating lost loved ones, friends, or family for personal
